Terms of Service

The terms that govern your use of Visa Vida.

Please read these Terms of Service ("Terms") carefully before using Visa Vida. These Terms are a binding agreement between you and Visa Vida LLC, an Ohio limited liability company doing business as Visa Vida ("Visa Vida," "we," "us," or "our"). They govern your access to and use of our website at myvisavida.com, our application, and the services we provide through them (together, the "Services").

By creating an account, clicking "I agree," or otherwise using the Services, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree, do not use the Services.

1. Who can use Visa Vida

You must be at least 18 years old and able to enter into a binding contract to use the Services. By using the Services, you represent that you meet these requirements and are not barred from using them by any applicable law, regulation, or court order.

Visa Vida is not yet available in every US state. Some states require registration or bonding of immigration document preparers, and we do not offer the Services in a state until our compliance there is complete. Before you purchase, we ask where you live, and we tell you clearly if the Services are not yet offered in your state. You represent that your answers about your location are accurate. If we later find that your state of residence is one where the Services are not offered, we will stop work on your case and refund your purchase in full. We may refuse, suspend, or void service if we determine that you have used a virtual private network, a false location, or any other method to access the Services from a location where they are not offered.

2. What Visa Vida is, and what it is not

Visa Vida is a document preparation service. It is not a law firm. We are not attorneys, and we do not provide legal advice. We do not select forms or strategies for you, and nothing we provide is a substitute for the advice of a licensed immigration attorney or an accredited representative.

Using the Services does not create an attorney-client relationship between you and Visa Vida or any of our staff, and your communications with us are not protected by attorney-client privilege.

We do not represent you before the government. We do not file anything with U.S. Citizenship and Immigration Services (USCIS) or any other agency on your behalf, we do not submit a Form G-28, and we do not create or operate a myUSCIS account for you. You file your own application, and you appear on your own behalf before USCIS, the Department of Homeland Security, and the Department of State. This is true even if you purchase our optional print-and-mail add-on, which mails your printed package to you, never to USCIS.

We are not affiliated with the government, and USCIS forms are free. Visa Vida is not affiliated with, endorsed by, or sponsored by USCIS or any government agency. Blank USCIS forms are available at no cost at uscis.gov. The fees you pay us are for our preparation services only. They do not include any USCIS or other government filing fees, which you pay separately.

We do not guarantee outcomes. We make no promise about whether your application will be approved, how long it will take, whether USCIS will issue a request for evidence, or any other government action. You are responsible for the decision to file and for what you submit.

3. The services we provide

Visa Vida helps you prepare a family immigration application package. Depending on the application type you select (for example, a K-1 fiance petition or an IR1/CR1 spouse petition), the Services include:

  • a guided intake that collects the information your forms require;
  • preparation of your USCIS forms from the information you provide;
  • a step to upload and organize your supporting documents and evidence;
  • one review of your case by a member of our staff, together with a process in which we may send you clear, plain-language questions or requests for additional documents so we can complete your package; and
  • a finished, organized package that you download and submit yourself.

The review described above is performed by trained Visa Vida staff. It is a completeness and consistency review. It is not a legal review, and it is not a guarantee that your application is correct or that it will be accepted.

3.1 Optional print-and-mail add-on. If you choose paper filing, we may offer an optional, separately priced add-on in which we have your finished package professionally printed and mailed to you at the US mailing address you provide, so you can sign it and mail it to USCIS yourself. The total price of the add-on is shown before you are charged. The package is always mailed to you. We never mail anything to USCIS or to any other party on your behalf.

3.2 What the Services do not include. For clarity, the Services do not include, and we will not provide: filing or submission of any application to USCIS or any agency; creation or management of a myUSCIS account; payment of government filing fees; legal advice or strategy; a determination of your eligibility for any immigration benefit; interview preparation; or any prediction of how the government will act on your case.

3.3 We may decline a case at screening. Before you purchase, we ask eligibility screening questions to confirm your case is one we can prepare. If your answers indicate legal complications that we do not handle, we may decline to offer you the Services. We may do so without providing a reason.

3.4 We may withdraw from a case in progress. If, after you purchase, we discover that your case involves legal complexity or circumstances we do not handle, we may withdraw from preparing it. If we withdraw under this section, we will refund your purchase in full. We may decline or withdraw without explaining our reasons, because doing so could require us to offer a legal opinion, which we do not provide.

4. Your responsibilities

You provide the information used to prepare your package, and you are responsible for its accuracy. By using the Services, you represent that the information you give us is true, correct, and complete to the best of your knowledge, and that you will not use the Services to make any false statement to the government. We may suspend or end your use of the Services if we reasonably believe you have provided false information or are using the Services to commit fraud.

You are responsible for reviewing your finished package before you submit it to USCIS, and for the submission itself. We prepare your package from what you give us. You confirm the result is accurate before you file.

If you provide information about another person, such as a beneficiary or a family member, you represent that you are authorized to do so.

You are responsible for keeping your account credentials confidential, for keeping your account information current, and for notifying us promptly if you suspect unauthorized access to your account.

5. Pricing, payment, and the 14-day refund policy

The price for each application type is shown before you purchase. Your fee is for Visa Vida's preparation services only. It does not include USCIS or other government filing fees, or any taxes, which are your responsibility. Optional add-ons, such as print-and-mail, are priced separately, and the total is shown before you are charged.

Refunds. You may request a full refund within fourteen (14) days of purchase, provided you have not yet submitted your application for review. Submitting your application for review begins our preparation and review work. Once you submit your application for review, or once fourteen (14) days have passed since purchase, whichever occurs first, the purchase is non-refundable. Two exceptions apply regardless of timing: if we withdraw from your case under Section 3.4, or if we stop work because the Services are not offered in your state of residence under Section 1, we will refund your purchase in full. A request to delete your data under Section 7 is not, by itself, a request for a refund, and the two are handled separately.

Payment processing. Payments are handled by Stripe, a third-party payment processor. We do not store your full payment card details.

Billing disputes. If you believe there has been a billing error, please contact us first at help@myvisavida.com so we can investigate. Starting a chargeback before contacting us may result in suspension of your account, to the extent permitted by law.

6. Our data commitments

In plain language

We do not sell or 'share' your personal information (as those terms are defined under the CCPA/CPRA), and we do not use it, or permit our service providers to use it, to train artificial-intelligence or machine-learning models.

These commitments are described in full in our Privacy Policy, which is incorporated into these Terms.

We do not sell or "share" your personal information (as those terms are defined under the California Consumer Privacy Act, as amended by the California Privacy Rights Act), and we do not share it with advertisers or data brokers.

We do not use your personal information to train artificial-intelligence or machine-learning models, and we contractually require our service providers, including our AI provider, not to train their models on your data.

These commitments are described in full in our Privacy Policy, which is incorporated into these Terms.

7. Your data, retention, and deletion

When you use the Services, you consent to our collection, storage, transmission, and processing of your information as needed to provide the Services, including transmission to the Visa Vida staff member who reviews your case and to the service providers we rely on, such as our hosting and payment providers. Our Privacy Policy describes what we collect, how we use it, how we share it, and how long we keep it, and it controls in any conflict with this section.

Retention. After your package has been delivered, we retain your information for a limited archive period of three years, as described in our Privacy Policy, after which it is deleted in the ordinary course.

Deletion. You may request that we delete your data at any time by contacting help@myvisavida.com. When you do, we delete your information, including files held in our storage, except for a minimal set of records we are required to keep, such as basic payment records. As noted in Section 5, a deletion request is handled separately from any refund request.

Compelled disclosure. We may access, preserve, or disclose your information where we believe in good faith that doing so is required by law, regulation, legal process, or a governmental request.

De-identified data. We may use information that has been aggregated or stripped of personal identifiers to operate, secure, and improve the Services.

8. Acceptable use

You agree not to misuse the Services. You will not use the Services for any unlawful or fraudulent purpose, prepare or submit false statements to the government, upload another person's information without authorization, interfere with or overload the Services, or attempt to scrape, copy, reverse engineer, or derive the source code of any part of the Services. Violating this section may result in immediate suspension or termination.

9. Intellectual property and content

The Services, including our software, website, designs, text, and other content, are owned by Visa Vida or our licensors and are protected by intellectual property laws. We grant you a limited, personal, non-transferable license to use the Services to prepare your own application. You may not copy, modify, distribute, or create derivative works from the Services except as the Services expressly allow.

You keep ownership of the documents and information you upload. You grant us a limited license to host, store, and use your uploaded content solely to provide the Services to you. We do not use your immigration documents to promote our business.

10. Third-party services

The Services rely on third-party providers, including hosting, authentication, and payment processors. We are not responsible for interruptions, errors, or damages caused by these third-party services. Your use of a third-party service may be governed by that provider's own terms.

11. Disclaimer of warranties

The Services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure. Some jurisdictions do not allow certain warranty exclusions, and in those jurisdictions our warranties are limited to the extent permitted by law.

12. Limitation of liability

To the maximum extent permitted by law, Visa Vida and its owners, employees, contractors, and service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, business, or goodwill, arising out of or related to your use of the Services, regardless of the legal theory.

To the maximum extent permitted by law, our total liability for any claim arising out of or related to the Services will not exceed the greater of (a) the amount you paid us for the Services giving rise to the claim, or (b) US$100. Some jurisdictions do not allow certain limitations, and in those jurisdictions our liability is limited to the maximum extent permitted by law. Nothing in these Terms limits any consumer rights that cannot be waived under applicable law.

13. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Visa Vida and its owners, employees, contractors, and service providers from any claims, losses, liabilities, damages, costs, and expenses, including reasonable attorneys' fees, arising out of or related to your use or misuse of the Services, the information you provide, or your violation of these Terms or of any law. This obligation survives termination of your account and these Terms.

14. Dispute resolution and governing law

These Terms, and any dispute arising out of or relating to them or the Services, are governed by the laws of the State of Ohio, without regard to its conflict of laws rules.

Before filing any claim, you and Visa Vida agree to try to resolve the dispute informally. Either party may begin by contacting the other in writing and describing the dispute and the relief requested. If the dispute is not resolved within 30 days, either party may proceed as described below.

Except for claims that qualify for small claims court, and except for claims seeking injunctive relief for misuse of our intellectual property or the Services, any dispute will be resolved by final and binding individual arbitration administered by the American Arbitration Association under its applicable consumer rules. You and Visa Vida waive any right to a jury trial and, to the maximum extent permitted by law, any right to participate in a class action or other representative proceeding. Nothing in this section limits any non-waivable rights you have under the law of the place where you live.

15. Termination

You may stop using the Services at any time and may request deletion of your account as described in Section 7. We may suspend or end your access to the Services if you violate these Terms, if we are required to by law, or if continuing to provide the Services to you is not feasible. The sections of these Terms that by their nature should survive termination, including those on intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution, will survive.

16. Changes to these Terms

We may update these Terms from time to time. When we make a material change, we will ask for your agreement to the updated Terms through a clear prompt in the product before you continue using the affected Services, and we will keep a record of prior versions. If you do not agree to the updated Terms, you must stop using the Services, and you may request deletion of your data.

17. General

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, sale of assets, or other change of control. We are not liable for any delay or failure to perform caused by events beyond our reasonable control. These Terms, together with our Privacy Policy, are the entire agreement between you and Visa Vida regarding the Services and supersede any prior understanding. If we publish these Terms in another language, the English version controls. Section headings are for convenience only.
